When making a reservation at Akyüz Otel hotel using one of our digital channels such as the Internet, our mobile site or our application ("Site"), these booking terms and conditions ("Booking Conditions") together with the Privacy Policy, Website Terms and Conditions of Use and any other written information that we will bring to your attention before confirming your reservation, will be applied.

 

Please read the Booking Conditions carefully, which govern our respective rights and obligations and explain a few important things.

 

In these Booking Conditions, the terms "you" and "your" are used to include the first person named when the booking is made and all those on whose behalf the booking is made. The Site is owned and managed by Akyüz Otel Hotels & Resorts Management AG, Oberneuhofstrasse 12, 6340 Baar, Switzerland ("we", "us", "our").

 

When you book, your booking will be with us. By making a reservation, the first person to make a reservation agrees to the following on behalf of all persons mentioned in the booking:

 

The person has read these Booking Conditions and agrees to be bound by them and is the authorised person;

You agree to the use of the information by us in accordance with our Privacy Policy;

The person is over 18 years of age and where there are arrangements for age-restriction related services, he or she declares that he or she and all accompanying persons are of suitable age to receive these services, and

He accepts financial responsibility for the payment of the reservation on behalf of all persons mentioned in the reservation.

1 Booking

When booking a room, please follow the instructions on the Site. You will need to provide your credit or debit card details in order for your booking to be processed.

 

Please check that the details of your reservation are correct before submitting your reservation request. If you do not provide accurate information, we will not be liable for any failure or delay to process your booking.

 

Your booking is confirmed and the binding contract will be valid between us and sent to you as soon as it is confirmed together with the valid confirmation number provided when the details of your booking are confirmed. Upon receipt, if you believe that any details in the confirmation are incorrect or require changes, you must contact us immediately or it may not be possible to make changes later.

 

We reserve the right, in our sole discretion, to refuse a booking and refuse to send confirmation.

 

2. Payment for your booking

Payment can be made in cash or by credit/debit card at Akyuz Hotel hotel.

 

Depending on the type of booking, you may be asked to pay the full amount of your reservation at the time of booking, in which case your credit/debit card may be charged at any time between the time between check-in from your booking and the arrival at the hotel.

 

If you have not made the payment in full at the time of booking, you will have to pay in full upon arrival at the hotel.

 

If we have not received full payment on time and in full, we are entitled to make an assumption that you wish to cancel your booking. In this case, we reserve the right not to refund any payments already made and you must pay the cancellation fees indicated to you at the time of booking.

 

You must pay for any optional charges (e.g. minibar, additional meals, etc.) directly to the hotel prior to check-out.

 

3. Fees

The price of your booking and the conditions for payment, changes and cancellations may vary depending on your room, booking type and other factors and you will be notified of these conditions at the time of booking. Please note that all prices are subject to availability.

 

Our prices are based on a "dynamic pricing" model and are regulated separately by each hotel depending on the way they book, so there may be fluctuations depending on supply and demand. Your booking fee will be confirmed at the time of booking and will not be changed in the event of price fluctuations between the dates of your booked stay and departure. You should always check the prices at the time of booking.

 

Unless otherwise stated on the site, additional services (breakfast, half board, full board, etc.) are not included in the price. The tourist tax stated on the rates page is to be paid directly to the hotel, except for online prepayments where this amount may be included.

 

Prices can also vary depending on the currency and exchange rate differences you choose for your payment. Prices converted into foreign currency are given for informational purposes only and are not binding. The currency confirmed on the booking is secured (if this currency differs from the one used at the hotel, possible exchange charges will be the responsibility of the customer). If payment is due on arrival or departure and the customer's currency is not the same as the hotel's currency, the rate quoted by the hotel may differ from the one quoted at the time of booking, due to possible differences between the date of booking and the dates of your stay at the hotel.

 

We reserve the right to correct errors in both the advertised and confirmed prices. As soon as we realize the mistake, we will do what is necessary.

 

The price of your confirmed reservation will always be subject to correction of errors and changes caused by the government, such as changes in VAT or other government-mandated changes and changes in the exchange rate, and as a result, we reserve the right to reflect these as an increase in the price of your confirmed reservation.

 

Some promotional offers available on the Internet are sold exclusively online, i.e. via remote sales, and are in no way valid at the hotel reception.

 

4. Accuracy

We strive to ensure the accuracy of all information and prices contained on our site and in marketing materials; However, changes or errors may occur from time to time and we reserve the right to correct other details and prices in such cases. You should check all other details of your chosen reservation and the current fare before booking.

 

5. Changes made by you

If you wish to make any changes to your confirmed reservation, you must follow the procedure outlined in the booking confirmation. We will endeavour to assist you, but we may not always be able to accommodate your request for changes. If any changes are made, you will be responsible for paying any additional costs incurred. See also the special conditions notified to you at the time of booking.

 

6. Cancellations made by you

If you wish to cancel your confirmed reservation, you must follow the procedure outlined in the booking confirmation.

 

Note that some reservations cannot be refunded in case of cancellation once confirmed. If the reason you gave for your cancellation is covered by the terms of your insurance policy, you can claim these costs back.

 

7. Refunds

If you decide to check-out before the expected date, we are under no obligation to refund the unused portion of your booking or any other costs you are responsible for bearing. Depending on the circumstances, such refunds may be covered by your travel insurance, we recommend that you submit claims for this directly to your insurance company.

 

8. If we cancel your booking

If you fail to make all payments required for your reservation in full and on time, or if you breach the material provisions of these Booking Conditions, we may cancel your reservation at any time with immediate effect by written notice (including email). The statutory rights and remedies we have as a result of a breach of contract also remain reserved.

 

In exceptional circumstances due to 'Force Majeure' we may need to cancel your booking. If this happens, we will inform you as soon as possible and:

 

If you have paid for your booking, we will refund your payment to you; or

If you haven't made a payment for your reservation, you won't be asked to pay.

We regret that we are unable to reimburse you for any costs or losses you may incur as a result of such changes or cancellations.

 

As used in this clause, 'Force Majeure' refers to all events that we could not have foreseen or prevented despite taking full care and as a result were unable to provide you with your room. These events include, but are not limited to, war, threat of war, terrorist activities causing civil unrest and their consequences or the threat of such activities, including insurgency, interference by government or other regional and national authorities, including port and river authorities, industrial disputes, closure of entrances and exits, natural or nuclear disasters, fire, chemical or biological disasters and adverse effects of weather, sea, ice and river conditions, and similar similar events beyond our control. events.

 

9. Insurance

10 Special Requests

If you have a special request, you must let us know at the time you book. Although we will endeavour to comply with your reasonable requests in relation to the hotel concerned, we regret to inform you that we or the hotel cannot guarantee that these requests will be met unless we have been notified in writing that they will be met by special approval. The fact that a special request is mentioned in your confirmation or other document or forwarded to the hotel is not a confirmation that your request will be met. Failure to comply with any of your special requests will not be considered a breach of contract by us unless the request has been specifically approved. Reservations are not permitted if any special requests are met.

 

11 Guests with Disabilities and Medical Problems

If you or any accompanying person has a medical condition or disability that may affect your stay, please let us know all the details in writing at the time of booking before making your reservation so that we can review the availability of the selected room. In any case, you must provide the details in writing at the time of booking. If the hotel has difficulty properly meeting the specific needs of the person concerned, we reserve the right to refuse the booking or, if full details were not provided at the time of booking, to cancel if we become aware of these details.

 

12. Complaints

If you wish to make a complaint during your stay, please inform the hotelier immediately and he will take the necessary measures immediately. If the issue that is the subject of your complaint is not resolved or if you want to take your complaint to the next level, you can contact us at info within 7 days of the end date of your stay with your reservation number and all other necessary information. In the light of this information, your problem will be quickly identified and the necessary response will be given. If the procedure described in this clause is not followed, it may not be possible for us and the relevant supplier to investigate your complaint, which may affect your rights under this contract.

13 Behaviors

When you make a booking, you accept responsibility for any damage or loss caused by you or an accompanying person. The cost of such damage or loss must be made immediately to the hotel in full at that time. Otherwise, you will be responsible for all subsequent claims brought against us (including all of your own and accompanying persons' legal costs) and their consequences. Hotels reserve the right, in their sole discretion, to terminate your stay or any accompanying person at any time if they determine that you have behaved inappropriately. No refund will be given in this case. In addition, neither the hotel nor we will have any obligation to pay any compensation or to cover your costs or expenses due to the termination of your stay.

 

14 Our Obligations

We shall not be liable and shall not be liable for, any compensation, for injuries, illnesses, loss of life, damages, damages, expenses and other claims, regardless of their nature, if:

 

the behaviour(s) and/or negligence of the affected person(s)

the conduct(s) and/or negligence of the third party(s) that are not related to the provision of the accommodation under the contract and could not have been foreseen or prevented in advance

abnormal or unusual circumstances beyond our control that, despite all care and attention, could not be prevented, or

events that, despite all care and attention, we could not have foreseen or prevented.

Whatever the reason, the amount of compensation we are liable to you for making against you is limited if:

 

(a) For other claims, including loss and/or damage to luggage and/or personal effects and illness: the maximum amount we can pay you in respect of such claims may not exceed the total amount of the insurance policy applicable per person for such losses, as you are deemed to have an appropriate policy to cover such losses.

 

(b) In the case of claims not covered by clause (a) above and involving injury or loss of life: the maximum amount payable in respect of such claims shall not exceed twice the amount paid by or on behalf of the affected person(s). This maximum amount will only be paid if you do not avail yourself of a benefit in connection with your booking.

 

In order for our liability under this clause to be accepted, you must submit your requests strictly following the complaints procedures described in these terms.

 

When any payment is made, the person(s) receiving the payment (or their parent or guardian if such person(s) is under 18 years of age) must assign to us or our insurance company their rights against third parties and, to a reasonable extent, provide the necessary assistance and support in matters required by us or our insurance company.

 

We will not accept any liability for any losses, damages, costs and other claims (a) based on information provided by you prior to booking but not yet accepted, for which we could not foresee that you would suffer as a result of our breach of contract between us, or (b) relating to any trade.

 

We will not accept any responsibility for services or facilities that are not covered by the contract between you and us. Excursions or other tour programs that you book or pay for during your stay at the hotel are outside the scope of the contract between you and us.

 

The photographs shown on our site are not binding. All efforts will be made to ensure that the photographs, graphic images and text used to promote the hotels reflect the accommodation offered as accurately as possible, but differences may arise from these images, especially as a result of changing the furniture and décor or possible renovation works.

 

Hyperlinks used during booking verification may provide links to websites outside the Site, but we will not accept any responsibility for the content of such websites or the services offered on such websites.

 

15. Disputes

Guests should first contact the hotel to resolve disputes. If mutual agreement cannot be reached within 60 days, guests can contact our head office directly via email.

 

16. Applicable law and jurisdiction

Without prejudice to any mandatory, protective provisions that may apply in your country of residence, both parties agree that these Booking Conditions and any agreements to which they apply shall be governed in their entirety in accordance with the laws of Trabzon and that the exclusive jurisdiction of the Swiss Courts shall apply to any dispute.

 

17. Changes to Booking Conditions

These Booking Conditions may be amended and/or supplemented by us at any time. In this case, the new version of the Booking Conditions will be published by us immediately on the Internet and will automatically come into force for all our customers.
